Impact 8/10
CMS finalized the Marketplace Integrity and Affordability rule in June 2025, tightening special enrollment period eligibility, adding upfront income verification requirements, and imposing a $5 monthly premium on some fully subsidized auto-reenrolled plans. In City of Columbus v. Kennedy, a federal district court in Maryland stayed six of eight challenged provisions on August 22, 2025, a decision the Fourth Circuit left in place that September. The stayed provisions remain inoperative while litigation continues; the remaining provisions took effect August 25, 2025.
