Overtime salary threshold rolled back

Enacted7/10
Federal · State of Texas v. DOL (E.D. Tex., Nov 15, 2024); DOL technical amendment, 91 FR (May 15, 2026) · Effective May 15, 2026
Impact 7/10

A federal court vacated the Biden DOL's 2024 rule that had raised the overtime-exemption salary threshold toward $58,656, and the Trump DOL dropped the government's appeals rather than defend it. On May 15, 2026 DOL issued a final rule technical amendment formally restoring the 2019 threshold of $35,568 ($684 per week). Salaried workers earning between the old and new thresholds lost guaranteed overtime eligibility.
