HUD has proposed rescinding the 2012/2016 Equal Access Rule that requires HUD-funded housing programs (homeless shelters, public housing, Section 8) to serve people without discrimination based on sexual orientation or gender identity; the rule is still in the proposal stage (comment period closed June 29, 2026) and has not been finalized. Separately, in February 2025 HUD announced it would stop enforcing the existing rule administratively.
