Impact 5/10
Broad tariffs imposed under the International Emergency Economic Powers Act were struck down: the Court of International Trade ruled against them in May 2025, the Federal Circuit affirmed in August 2025, and the Supreme Court held 6-3 in February 2026 that IEEPA does not authorize tariffs. Roughly $166 billion in refunds is underway. The administration has replaced some tariffs using other authorities (Sections 122 and 301), and separate Section 232 sectoral tariffs were unaffected.
