A July 14, 2025 HHS notice reinterpreted the 1996 welfare law to classify Head Start, Title X family planning, community health centers, mental health and substance use programs, and other services as federal public benefits closed to undocumented immigrants, effective immediately. For the first time in Head Start's 60-year history, providers would have to verify children's immigration status. Federal courts issued preliminary injunctions in September 2025 blocking enforcement in plaintiff states, and the government's appeal is pending.
