A federal court in Texas set aside the FTC's 2024 rule banning most non-compete agreements on August 20, 2024. On September 5, 2025 the Trump FTC voted 3-1 to dismiss its appeals and accede to the vacatur, permanently abandoning the rule. The FTC had estimated the ban would free about 30 million workers, roughly one in five, from contracts restricting them from changing jobs or starting competing businesses.
