Emergency abortion care guidance under EMTALA rescinded

Enacted6/10
Federal · CMS rescission of QSO-22-22-Hospitals (June 3, 2025) · Effective Jun 3, 2025
Impact 6/10

On June 3, 2025, CMS rescinded 2022 guidance stating that the Emergency Medical Treatment and Labor Act requires hospitals to provide abortion care when it is the stabilizing treatment for a medical emergency, even in states that ban abortion. CMS said the guidance did not reflect the administration's policy while stating it would continue enforcing EMTALA for pregnant patients. Physicians and hospitals in states with abortion bans lost the federal directive that had explicitly protected emergency abortion care.
