DHS announced on September 5, 2017, that it would wind down DACA and gave Congress six months to act. Courts blocked the rescission, and later litigation brought by Texas has kept the program in limbo: USCIS accepts but is prohibited from granting new initial applications, while roughly half a million existing recipients may renew under court order. In January 2025 the Fifth Circuit held the DACA rule unlawful but narrowed relief to Texas, and implementation remains pending before the district court as of August 2026, with renewal processing continuing but slowing significantly.
