Clean Power Plan replaced with weaker Affordable Clean Energy Rule

Enacted5/10
Federal · EPA Affordable Clean Energy Rule · Signed Jun 19, 2019
Impact 5/10

EPA repealed the Obama-era Clean Power Plan and replaced it with the Affordable Clean Energy rule, which limited required emission reductions to heat-rate efficiency improvements at individual coal plants instead of shifting generation to cleaner sources. The D.C. Circuit vacated the ACE rule in January 2021, and in West Virginia v. EPA (2022) the Supreme Court separately held that the Clean Power Plan's generation-shifting approach exceeded EPA's authority.
