Federal · S.J.Res. 18, Pub. L. 119-10 (Congressional Review Act) · Signed May 9, 2025
Impact 7/10
Congress used the Congressional Review Act to repeal the CFPB rule that would have capped large-bank overdraft fees at about $5, and Trump signed the resolution on May 9, 2025 as Public Law 119-10. The CFPB had estimated the rule would save consumers roughly $5 billion per year in overdraft fees, which fall disproportionately on low-income households. Under the CRA the agency cannot issue a substantially similar rule without new legislation, so banks may continue charging fees of $35 or more.
