Federal · HHS Section 1557 Final Rule, 89 FR 37522 (May 6, 2024); Trump HHS rescissions and non-enforcement (2025) · 2025
Impact 7/10

The Biden HHS 2024 rule interpreted Section 1557's ban on sex discrimination in federally funded health programs to cover sexual orientation and gender identity, but federal courts stayed those provisions in 2024. On taking office the Trump administration issued an executive order recognizing only two sexes, and HHS rescinded its gender-affirming care and Section 1557 civil rights guidance in February 2025 and stopped enforcing gender identity discrimination claims. The 2024 rule has not been formally rescinded, and HHS has signaled further regulatory rollback. LGBTQ+ patients currently lack federal Section 1557 enforcement of gender identity protections.
